Letting agent charges renters £300 just to VIEW a property

The practice by a London agency breaches official guidelines and could also be illegal

A LETTING agency in London has been charging prospective tenants hundreds of pounds to view properties, according to renters.

Several customers of the letting agency claim they were initially told that their payments would be refunded if they did not like the property.

But after the viewings, they say they were told that the money would not be refunded after all.

According to an investigation for the , Flintons, which has one branch in East London, demanded cash payments up front before renters were allowed to take a look at potential properties.

The agency told The Sun it denies the allegations in full and claims it does not charge any fees for viewings.

It said a holding deposit is only taken where a prospective tenant wishes to exclusively reserve a property for themselves and the property is then taken off the market and not offered to any other person.

Israel Kujore, who responded to a Flintons advert with his friend Harry, told the BBC that they paid £300 each to see one property before seeing bad reviews about the business online.

He told the BBC: "£300 is half my rent gone. What can I do? I don't have the money to sue them. I don't have legal expertise to deal with it - I'm powerless."

  • What is a tenancy agreement and what should I look out for?
    The tenancy agreement is a contract between you and your landlord. Most tenancy agreements are an assured shorthold tenancy agreement for a fixed term - usually six to 12 months.
    Make sure it include your details and those of your landlord as well as the duration of your tenancy from start to the agreed finish date.
    It should also include what payments are expected, like council tax, utilities and service charges as well as the services your landlord will provide, such as maintenance of common areas to avoid.

  • Ask about maintenance work and require repairs if neccessary:
    Which? investigation revealed letting agents brushed off questions about maintenance, with many stating that work would be carried out before the tenant moved in, or would need to be dealt with by the landlord.
    But property expert Kate Faulkner told Which? that tenants should avoid this type of verbal agreement.
    Instead, required repairs should be made conditional as a special clause in the tenancy agreement.

Flintons told the BBC it issued receipts specifying that the sums involved were non-refundable, but Israel and other tenants with similar experiences claim they had not been given this document to sign until after they had made the payment.

Last month, Trustpilot user Marielle commented: "Me and two friends were moving to a new property and we seeked Flintons guidance. Worst thing that happened to us.

"They tricked us into paying a "holding fee" of £300 each to which they assured it was refundable (words wise) and took us to the administration office to pay.

"After we saw the property and decided against it, the agents... reacted with indifference and told us they didn't know anything about the money."

Another user called Lelu said: "We are a couple and we had a very BAD experience with Flintons agency, the WORST ever!! Not professional and honest at all!!

"We basically paid for a deposit for a double room so this room was supposed to be reserved for us, but when we came back to the agency they told us that they rent our room!!

"So we let them find another room for us because they had our deposit of £300 but the same thing happen again and they went on like this for four times!!"

Official guidelines from the Competition and Markets Authority say that a letting agency "should not place the prospective tenant under undue pressure to pay a deposit or any other pre-tenancy agreement".

It also notes that to "require a deposit from a tenant before they have been given the opportunity to inspect the property or the tenancy agreement" could constitute an "aggressive practice".

Your rights as a tenant

AS a tenant in a privately rented home, these are your rights as outlined by the government:

  • Live in a property that’s safe and in a good state of repair
  • Have your deposit returned when the tenancy ends - and in some circumstances have it 
  • Challenge excessively high charges
  • Know who your landlord is
  • Live in the property undisturbed
  • See an  for the property
  • Be protected from unfair eviction and unfair rent
  • Have a written agreement if you have a fixed-term tenancy of more than 3 years

If you have a , it should be fair and comply with the law.

If you don’t know who your landlord is, write to the person or company you pay rent to.

Your landlord can be fined if they don’t give you this information within 21 days.

David Smith, a leading specialist in residential landlord and tenant law, told the BBC that the practice was legally questionable.

"Asking somebody for money, without being able to see what that contract is about, to do a viewing, would quite likely to be seen by professional people in the property sector as unreasonable and unfair behaviour," he said.

"It is therefore likely to be an offence under the consumer protection from unfair trading regulations."

Meanwhile, Bethan Owen, partner of legal firm Kingsley Napley, told The Sun: "In England, there is currently no cap on the level of fees that lettings agents or landlords can charge to tenants.

"The Tenant Fees Bill [expected to come into force next year] would ban letting fees and the majority of other upfront fees payable by tenants to rent a property.

"It would also cap the amount of refundable security deposit a tenant would be required to pay to the value of six weeks’ rent and cap the amount of holding deposit a tenant could be required to put down to secure a property to the value of one week’s rent.

"We would hope that the Tenant Fees Bill will ban letting agents from charging prospective tenants fees to view properties."

Flintons, which denies any wrongdoing, told The Sun: "We deny any allegation that prospective clients are asked to pay a holding deposit to be able to have a viewing.

"Whilst we have been informed of three instances where prospective clients had raised complaints, we provided suitable responses and believe that we demonstrated that the version of events that the complainants had provided were not entirely accurate and there was clear knowledge that any deposit taken was non-refundable.

"Notwithstanding our position, we have reviewed our procedures and have provided further training to staff and have also now amended our holding deposit form to further highlight that the deposit is non-refundable if a prospective client changes their mind."

The average household could save £300 each when the government finally implements a ban on letting fees, which is currently estimated to come into place next year.

Landlords are also about to be banned from charging tenants tip-off fees over damaged items.

Meanwhile, one in 10 ads on property website Zoopla is 'illegal' as they exclude people on housing benefits.
