Ayia Napa Brit convicted of making up brutal rape files appeal claiming judge was ‘discourteous’

THE British teen convicted of making up a rape claim has filed an appeal claiming the judge was “discourteous”.

The 19-year-old re­ported 12 Israeli youths for attacking her on holiday in Cyprus last year.

Cops arrested the men but they were later freed while she was charged with public mischief — getting a four-month suspended jail sentence.

But the trial saw judge Michaelis Papathanasiou cut across defence ex­p­erts while giving prosecution witnesses free reign.

In an exclusive interview with The Sun earlier this year the girl described the rapists as a “pack of wolves” adding she “wanted to die” following the nightmare sex assault.

Lawyer Michael Polak of Justice Abroad has submitted a 156-page skeleton argument to the Cyprus Appeal Court.

He said it would claim the judge prejudged parts of the offence and was discourteous, “denying the teenager a fair trial.”

Mr Polak said:"We have submitted a detailed skeleton argument which sets out exactly why the teenagers conviction, which was reported around the world in January, is unsafe and needs to be overturned.

"The judge did not provide the Defendant with a fair hearing and closed his mind to an essential element of the offence by continuously shouting ‘this is not a rape trial’.

Mr Polak added:”It will be submitted on behalf of the teenager that as well as seeming to prejudge elements of the offence, the trial judge also acted with discourtesy towards the teenager and the defence representation in such a way, so as to deny the teenager a fair trial.”
