‘Fake penis sex attacker’ Gayle Newland has her conviction overturned and will face a re-trial
The 26-year-old's appeal against her eight year prison sentence was successful with the matter now to face a new trial
A LESBIAN jailed for allegedly using a dildo during sex to dupe another woman into thinking she was a man has been freed after her conviction was quashed.
Gayle Newland, 26, sobbed uncontrollably as she was granted a fresh trial on three counts of sexual assault by penetration.
Lady Justice Hallett at the Court of Appeal in London criticised the summing up of Judge Roger Dutton at the original trial last year saying the conviction was unsafe.
She ordered that Newland - who watched by video link dressed in navy prison fatigues - be freed immediately from HMP Low Newton in Durham.
As Newland, of Willaston, Cheshire buried her head in her hands weeping, guards brought her a box of tissues.
Present in the public gallery for the judgement were members of her well-to-do family who left without commenting.
The accused is the daughter of a former building firm boss and grew up in a £500,000 house in the Wirral.

Newland was educated at £12,400-a-year Queen's School in Chester and later worked as a marketing executive and a personal trainer.
In November, she was dragged screaming to the cells at Chester Crown Court after she was jailed for eight years.
It's said she used a £20 strap-on sex toy to hoax her victim in 2013.
Newland insists the other woman knew her gender all along and they were taking part in a mutual fantasy.
Asked by the judge yesterday if she understood the ruling, she cried: "Yes, I think so."
A new trial is expected to take place next year.
