The long-haired pervert, 34, quivered in the dock as he was hauled before a crown court judge.

Wood admitted watching other people doing a private act without their consent for his own sexual pleasure.

Jo Martin, prosecuting, told how he sneaked into the couple's flat as they were having sex on July 27.

They stopped when they noticed an arm holding a mobile phone stretching round the bedroom door.

Miss Martin said: "He was extremely remorseful and apologised straight away."

It turned out the bungling voyeur's mobile phone did not record any video, Plymouth crown court heard.

But the woman he spied on told police she has since "struggled to be at home" and believes the shock of the offence has made her ill.

City magistrates had earlier ruled Wood's crime was so serious he must be dealt with by a crown court judge, who could have jailed him for up to two years.

And the perv was visibly shaking in the dock as the case was outlined for sentencing, .

But Judge Paul Darlow told him: "Please relax, you are not going to prison."

Jobless Wood, who has an unspecified medical condition, was sentenced to a three-year community order with 20 days of one-to-one probation supervision.

He will not have to sign the sex offender register.

The judge said: "The defendant was immediately apologetic and remorseful.

"I do not think he could have foreseen the consequences that his offending would have.

"I suspect that this has been a frightening enough experience for him not to do anything like this."
