Mel, 41, has demanded sole custody of their five-year-old daughter Madison, after initially saying she’d be prepared to share custody.
But Stephen insists on shared parental duties and reportedly wants £10 million of Mel's estimated £48 million fortune.
Mel’s decision to begin divorce proceedings last month, just 11 weeks before their ten year anniversary, could save the former Spice Girl millions.
Under Californian law, she could have been forced to support Belafonte, 41, indefinitely had their marriage spanned a decade.
But now it’s likely the court will set the duration of support at half the marriage’s length.
Just days ago, Mel filed papers claiming Stephen had been "violent and abusive" during their marriage and forced the singer to take part in threesome and make sex tapes.
One of her claims involved former nanny Lorraine Gilles being pregnant with her husband's child in 2014.
But Stephen has denied any wrongdoing and reports he is planning to call on German nanny Lorraine to back him in court.
Her parents are quoted saying their daughter knew nothing of any domestic abuse.
Lorraine’s dad Volker said: “She never saw any violence. She would not have stayed if she had.
“She looked after the kids, she was practically a part of the family. But nothing happened when she was there that made her feel uncomfortable.”
Mel and Stephen have a scheduled LA court hearing for April 24.
